These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “you”) and CloudHostingGermany (“Provider”, “we”, “us”, “our”) governing your use of our web hosting, cloud server, VPS hosting, dedicated server, and related services.
By subscribing to or using any of our services, you agree to be bound by these Terms.
2. Account Registration
You must register for an account and provide accurate, complete information. You are responsible for safeguarding your login credentials and all actions taken under your account.
3. Service Usage
3.1 Permitted Use: Services must be used in compliance with applicable laws, including fair use and intellectual property rights.
3.2 Prohibited Use: You must not host illegal content, engage in hacking, spamming, or other harmful activity.
4. Payments and Billing
Fees for services are payable in advance per each billing cycle. Failure to pay on time may result in suspension or termination of your services.
5. Suspension and Termination
We may suspend or terminate services if:
- You violate these Terms.
- Payments are overdue.
- Required verification information is not provided upon request.
6. Intellectual Property
All materials, software, and content provided by CloudHostingGermany remain our intellectual property. You retain ownership of your data and content you upload to our services.
7. Limitation of Liability
To the maximum extent permitted by law, Provider’s liability for any damages arising out of or related to these Terms or use of services is limited to the amount you have paid for the applicable services in the preceding 12 months.
8. Indemnification
You agree to indemnify and hold CloudHostingGermany harmless from any claims, losses, damages, or expenses arising from your use of the services, violation of these Terms, or infringement of third‑party rights.
9. Governing Law
These Terms shall be governed by the laws of the Federal Republic of Germany.
10. Changes to Terms
We may update these Terms. Continued use of services following changes constitutes acceptance of the revised Terms.
